Welcome to HomeInsightCore, a Tennessee-based provider of real estate data APIs ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, application programming interface (API), documentation, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User" or "you") and HomeInsightCore. Your use of the Service, including registration, API access, or payment, signifies your acceptance of these Terms, our Privacy Policy, and any additional documentation, guidelines, or policies incorporated herein.

2. Description of Service

HomeInsightCore provides a secure, RESTful API that delivers comprehensive real estate data for properties located in the State of Tennessee. Data includes, but is not limited to: property listings, ownership records, sales history, tax assessments, valuations, market trends, and parcel details. All data is sourced under license from CoreLogic and is intended for lawful, non-discriminatory use.

3. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes and in compliance with all applicable federal, state, and local laws, including the Fair Housing Act, FCRA, TCPA, and GDPR.
  • Not use the data to determine creditworthiness, employment eligibility, or rental approval (i.e., automated decision-making under FCRA).
  • Not resell, redistribute, sublicense, or bundle our API data with competing services.
  • Not reverse engineer, decompile, scrape, or attempt to extract underlying source code or database structure.
  • Maintain accurate attribution in all public-facing applications: "Data provided by CoreLogic via HomeInsightCore".
  • Comply with rate limits and usage quotas to prevent system abuse.
  • Not use bots, crawlers, or automation tools to bypass API restrictions.

4. API Access & Authentication

Access to the API requires registration and a unique, secret API key. You are solely responsible for maintaining the confidentiality of your API key. You must:

  • Store your API key securely and never expose it in client-side code or public repositories.
  • Rotate keys immediately if compromise is suspected.
  • Notify us at support@homeinsight.cloud of any unauthorized access.

We reserve the right to revoke or regenerate keys for security or policy violations.

5. Usage Tiers & Fees

Access is provided in tiered plans:

  • Free Tier: 1,000 API calls per month. Intended for development and non-commercial use only. No SLA.
  • Standard Tier: $149/month for 10,000 calls. Includes commercial use rights and email support.
  • Enterprise Tier: Custom call volume, dedicated support, SLA, IP allowlisting, and SSO. Contact sales.

Overage usage is billed at $0.015 per call. Fees are charged monthly in advance. All payments are non-refundable. Tennessee sales tax applies where required.

6. Data Disclaimer

THE SERVICE AND DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DATA MAY CONTAIN INACCURACIES, DELAYS, OR OMISSIONS. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE DATA.

7. Intellectual Property

All rights, title, and interest in and to the API, software, documentation, trademarks, and data (including compilations and structure) are owned by HomeInsightCore and/or CoreLogic. No rights are transferred except for the limited, revocable, non-exclusive, non-sublicensable license to use the Service as permitted herein. You may not copy, modify, distribute, or create derivative works without express written permission.

8. Termination

We may suspend or terminate your access immediately, without notice, for:

  • Breach of these Terms or misuse of the API.
  • Non-payment of fees.
  • Suspicion of fraud, scraping, or denial-of-service attacks.

Upon termination, you must cease all use and delete any stored data. Sections on Disclaimer, IP, Limitation of Liability, and Governing Law will survive.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY TENNESSEE LAW, NEITHER HOMEINSIGHTCORE NOR CORELOGIC SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR BUSINESS INTERRUPTION. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless HomeInsightCore and its affiliates from any claims, damages, losses, or expenses (including attorneysƒ?T fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any dispute shall be resolved exclusively through binding arbitration in Nashville, TN, under the rules of the American Arbitration Association (AAA). The arbitration award may be entered in any court of competent jurisdiction. The prevailing party is entitled to recover attorneysƒ?T fees and costs.

12. Changes to Terms

We may update these Terms at any time. The "Last Updated" date will reflect changes. Material changes will be communicated via email or website notice. Continued use after updates constitutes acceptance.
